Defects Liability Inspections
Whats a defect liability period?
Western Australian law provides for a period of time, after Practical Completion (a minimum of 120 days - although some contracts may offer more) where the builder is obliged to return at no cost and rectify any ommissions or defects which have become apparent after practical completion.
We strongly advise that you excercise you legal right to have the builder attend to rectify any building defects following PCI for which the builder cannot charge you.
The best time to do this is as close to the 120 days as you feel comfortable (we suggest 3 weeks prior). The closer you get the more items you will likley be able to have rectified at the one time. Be aware that if you leave it too late and miss the dead line the process to get the defects items rectified becomes a little tricky!
SHS Building Consultants can attend and inspect the residence during the defect liabiltiy period, and prepare a report identifying the items which should be rectified by the builder. Our report will reference accepted building standards and building codes which are recognised at the building Commission of Western Australia, should you have any difficulty getting defective work rectified by your builder during the defects liabilty period.
