Defective Building Work is defined by the Home Building Contracts Act:

Failure to perform the home building work in a proper and workmanlike manner and in accordance with the contract; and

Failure to supply materials that are of merchantable quality and reasonably fit for the purpose for which the owner required the home building work to be performed.

So what is defective building work?

Defective building work is defined by the domestic building legislation as:

a breach of any of the builder’s or tradespersons implied warranties or a failure to maintain the standard or quality of work specified in the contract.

Builders and tradespeople must honour the implied warranties in the Domestic Building Contracts Act - which requires that they:
carry out the work in a proper and workmanlike manner, in accordance with the plans and any specifications or agreements
ensure all materials supplied are good and suitable for the purpose and are new, unless otherwise stated in the agreement
carry out the work in accordance with all laws and legal requirements
carry out the work with reasonable care and skill and complete works by the date (or within the period) specified within the agreement
ensure new homes, extensions, renovations, repairs and kit homes (or similar) are suitable for occupation when completed
ensure other types of work and the material used are reasonably fit for the intended purpose.

How can an SHS Expert Witness Report help?

Our report will identify what the item is defective and what needs to be done to rectify it. The report will reference your contract, the Building Code of Australia, accepted industry practice or the Manufacturer installation requirements to ensure that your structure, or part of the structure has been lawfully constructed. The report may be used at a tribunal, hearing or court to achieve an outcome.
